Introduction

  • Welcome to ModernDojo Design. By engaging our services, you agree to the following terms and conditions. Our policies are designed to ensure a smooth, efficient, and mutually beneficial working relationship.

Project Scope and Revisions

  1. Initial Consultation
    Every project begins with a detailed consultation to define the scope and requirements.

  2. Defined Scope
    The scope of work will be clearly outlined in the project proposal and cannot be altered without mutual agreement and potential adjustment of fees.

  3. Revision Policy:

    • Each package includes several revisions, as detailed in the description.

    • Additional revisions beyond the included number will incur extra charges at a rate specified in the project proposal.

  4. Revision Requests:

    • Revision requests must be made within a specified timeframe from the date of the initial design presentation, as detailed in the project proposal.

    • Failure to request revisions within this timeframe will be considered acceptance of the design as presented.

Timelines and Deadlines

  1. Project Timeline
    A timeline will be established at the start of the project, outlining key milestones and deadlines.

  2. Client Delays
    Delays in providing necessary information, feedback, or approvals may result in project delays and could incur additional charges.

  3. ModernDojo Design’s Commitment
    We adhere to the agreed-upon timeline and will communicate promptly if unforeseen circumstances arise.

Payment Terms

  1. Deposits
    Projects over $250 are eligible for a non-refundable 50% deposit at the discretion of ModernDojo Design and are required to commence work. Projects under $250 do not qualify for deposits and must be paid in full.

  2. Final Payment
    The balance is due upon project completion, before the release of final files.

  3. Late Payments
    Late payments may halt work and/or a fee of 2.5% of the total project cost per day after a 5-business-day grace period.

Intellectual Property

  1. Rights Transfer
    Intellectual property rights of the final design will be transferred to the client upon full payment in the form of a revocable, non-exclusive, non-sublicensable, non-transferable, perpetual license. Rights can be terminated in the event of slander and/or defamation of character.

  2. Original Artwork
    All original artwork remains the property of ModernDojo Design until full payment is received.

Cancellation Policy

  1. Client-Initiated Cancellation
    If the client cancels a project, the deposit will not be refunded, and any work completed beyond the deposit value will be billed to the client.

  2. ModernDojo Design Initiated Cancellation
    If we must cancel a project due to unforeseen circumstances, the client will be refunded any deposit minus work already completed.

Limitation of Liability

  • ModernDojo Design shall not be liable for indirect, special, incidental, or consequential damages.

Agreement to Terms

  • By commissioning work from ModernDojo Design, you agree to our terms and conditions.
