Portrait Photography Terms & Conditions

Welcome to ModernDojo™ Design! Please read these Terms and Conditions carefully before using our photography services.

Image Release:

By booking a session with ModernDojo™ Design, the Client grants the Photographer the right to use images captured during the event/session for promotional, advertising, and marketing purposes. However, the Client retains personal use rights.

Delivery of Photos:

The Photographer will deliver the high-resolution digital photos via an online gallery to the Client within 24-48 hours from the end of the session/event. Edits will be posted to the same gallery after the client has selected the images within 48 hours to 10 business days from the day of the selection. Premium Retouches will be posted to the same gallery 2-3 business days per retouch from the selection day.

Note: This does not apply to events or commercial projects.

Timeliness:

The Client agrees to arrive promptly at the scheduled start time of the session/event. Delays caused by the Client may result in a shortened session.

Permits and Permissions:

The Client is responsible for obtaining any necessary permits, permissions, or approvals for the chosen location of the session/event. The Photographer is not liable for any issues arising from a lack of permits or permissions.

Weather Delay, Reschedule, or Cancellation:

In the event of inclement weather that affects the safety or quality of the session/event, the Photographer and Client will work together to reschedule at a mutually convenient time. Any fees paid will be applied to another service within ModernDojo Design if rescheduling is impossible.

Payment and Fees:

The Client agrees to pay the agreed-upon session/event fee in full at least 24 hours before the start of the session/event. Additional fees for travel, permits, or other expenses will be discussed and agreed upon in advance.

Cancellation Policy:

In the event of Client cancellation, the following fees apply:

Cancellation more than two weeks before the session/event: No fee; remaining funds will be used as a credit towards your next shoot and a same-cost service.
Cancellation up to five days before the session/event: 15% of the total cost of the shoot
Cancellation up to 48 hours before the session/event: 25% of the total cost of the shoot
Cancellation within 48 hours of the session/event: 50% of the total cost of the shoot

Note that the initial booking fee is non-refundable and is 50% of the total cost of the shoot, including travel expenses and ancillary costs to produce the shoot.

Photographer's Liability:

The Photographer is not responsible for any damage to or loss of personal property during the session/event. The Photographer's liability is limited to a refund of the session/event fee.

Client Cooperation:

The Client will cooperate with the Photographer's directions to ensure the successful capture of images.

Additional Services:

Both parties will discuss and agree upon additional services, such as extra hours or prints. Additional fees may apply.

Governing Law and Modifications:

The laws of Missouri govern these terms and conditions and represent the entire understanding between the parties. Any modifications must be in writing and signed by both parties.

By booking a session/event with ModernDojo™ Design, the Client acknowledges and agrees to the terms and conditions outlined here.
